Los Gatos Town Code
• Single-family dwellings of wood frame construction not more than two stories and/or including basement in height.
• Multiple dwellings containing no more than four dwelling units of wood frame construction not more than two stories and basement in height. Not more than four dwelling units per lot.
• Garages or other structures appurtenant to dwellings, of wood frame construction not more than two stories and basement in height.
• Agricultural and ranch buildings of wood frame construction.*• Nonstructural store fronts, interior alterations or additions, fixtures, cabinetwork, furniture, or other appliances or equipment including nonstructural work necessary to provide for their installation.
• Nonstructural alterations or additions to any building necessary to or attendant upon the installation of such storefronts, interior alterations or additions, fixtures, cabinetwork, furniture, appliances, or equipment.
• May not design any component that affects the safety of any building or its occupants, including but not limited to structural or seismic components.
* Unless the building official having jurisdiction deems that an undue risk to the public health, safety or welfare is involvedStructural Engineers * have no Limitations; may design any building of any type.

Not all homes or commercial buildings need a backflow valve. New structures, new installation or alterations of plumbing fixtures require the installation of a backwater valve if the lowest finished floor elevation is less than one foot above the uphill manhole cover of the public sewer system. Existing homes or commercial buildings located in older parts of Los Gatos may have been constructed or had plumbing repairs completed before the requirement of a backwater valve and may need backflow protection. Los Gatos Town Code section 22.20.055(b) provides the Town of Los Gatos is not liable for damage resulting from sewer overflow where the property owner or other person has failed to install and maintain a backflow valve.The Town suggests that while you are working on your plumbing system you have your plumber or West Valley Sanitation District investigate your property to see if a backwater valve is necessary to protect your property. Although the cost can vary, the one-time cost may save your personal property and help eliminate potential unnecessary hardships. Backwater Valve Handout

If your second appeal is denied, an appeal may be filed in the Santa Clara County Civil Court within 21 days from date of denial of the second appeal. This court will review the factual aspects of the case, the administrative process, and the decision of the Hearing Examiner. The decision of the Civil Court may be communicated in person or by mail.

For example, the curb may not be painted green but if there is a sign posted that limits parking to 30 minutes - the 30 limits limitation will be enforced.
Another example would be at a fire hydrant that does not have an accompanying red curb. It is still a violation to park within 15 feet of a fire hydrant.
If your vehicle was “impounded,” this means that the police department has placed a hold on the vehicle, and it may not yet be available for release. The most common reason for a vehicle impound is that it was driven by a suspended or unlicensed driver. If this is the case, the vehicle will be held for a period of 30 days, and you must wait for this time to elapse before requesting a release. After the 30 day period has passed, the registered owner may come to the police department to obtain a release. A fee set by Town Council will be charged for release of a stored or impounded vehicle. The registered owner will be required to show a valid driver’s license and proof of current registration for the vehicle. Should the registered owner not have a valid license, a current and valid government issued picture I.D. and the presence of a licensed driver, will be required. If the registration fees have been paid at DMV but a smog is still needed to complete the registration, the registered owner will need to bring in a 'moving permit' issued by the Department of Motor Vehicles. Note, you may also be charged by the towing company for towing and storage fees they incurred before they will release the vehicle.
If your vehicle was “stored”, it is available for immediate release. The procedure for this release is the same as for an impounded vehicle, but without the waiting period.
If your vehicle was "booted", you will need to pay any and all outstanding parking citations as well as the vehicle release fee within 72 hours of the "Boot" being placed on your vehicle tire. If the fees haven't been paid within the 72 hours, your vehicle will then be towed as a "stored" vehicle. You will then have to pay any incurred towed vehicle fees in addition to the vehicle release fee and any parking citations.

Walls are more substantial structures of masonry and typically require continuous footings and rebar. Permits are required for walls, except for retaining walls which are 4’-0” or less in height from the bottom of the footing and do not support a surcharge.

1. Only one (1) new second dwelling unit may be permitted on a lot. No new second dwelling unit is allowed upon a lot with an existing second dwelling unit. 2. Second dwelling units are allowed on conforming lots in the R-1, R-M and R-1D zones. They are not permitted in the Hillside Residential Area.3. Second dwelling units shall comply with the setbacks of the zone. 4. Detached second dwelling units shall not exceed one (1) story in height, and shall not exceed fifteen (15) feet in height. 5. 6. All second dwelling units (attached or detached) must comply with the floor area ratio for primary structures. 7. Second dwelling units must comply with lot coverage maximums for the zone except with regard to the addition of a single efficiency unit (as defined by the Uniform Building Code). 8. In addition to parking otherwise required for second units as set forth in section 29.10.150 of the Town Code, the number of off-street parking spaces required by this chapter for the primary unit shall be provided prior to the issuance of a certificate of use and occupancy and/or building permit, for the new second dwelling unit. In addition to the number of spaces as set forth in this section, additional spaces may be required if the following findings are made: a. Additional parking is directly related to the use of the second unit b. Additional parking is consistent with existing neighborhood standards applicable to existing dwellings. 9. The design, form, materials and color of a new second dwelling unit shall be compatible with the primary dwelling unit and the neighborhood. Second dwelling units shall retain the single-family appearance of the property. 10. All new second dwelling units shall comply with all the provisions of this chapter and other applicable Town codes. 11. The second unit shall comply with applicable building, health and fire codes. 12. Requests for expansion of a second dwelling unit shall be subject to the same requirements as a new second dwelling unit. Expansion of a second dwelling unit is defined as increasing the number of bedrooms or adding floor area in excess of thirty (30) square feet. 13. An application may be denied if it does not meet the design and development standards. An application may also be denied if the following findings are made: a. Acknowledgment of limiting the housing opportunities in the region. b. Adverse impacts on health, safety and/or welfare of the public. Accessory Building Information
• Required parking spaces: 3 spaces per unit, 2 spaces per condominium unit in addition to 1 space per unit for guest parking, unless the Planning Commission determines that more or less parking is necessary due to the size or type of housing unit(s). • Construction must meet current Uniform Building Code standards.• Overall loss of affordable rental units in the Town and consistency with the Housing Element of the General Plan. • Open Space Requirements:

375 KNOWLES DRIVE and 14205 CAPRI DRIVE - LOS GATOS, CAFACT SHEET

EXISTING USES:
The combined 5.1 acre site is improved with two buildings as described below.
1. Former County Clinic Building and Vacant Property (375 Knowles Drive)
The property consists of two parcels totaling 3.34-acres. Parcel 1 is approximately 1.1 acres and is currently improved with a 6,200-square foot single-story office structure. The building was constructed circa 1970 and was used as a mental health clinic. There are approximately 41 parking spaces on Parcel 1. Parcel 2 is a 2.24-acre unimproved and vacant site.
2. Los Gatos Courthouse (14205 Capri Drive)
The property is currently improved with an approximately 12,467-square foot single-story courthouse structure on 1.8 acres. The building was constructed circa 1960 and was renovated in 1992. There are approximately 67 parking spaces on the property.
ALLOWED USES:
Town Code Section 29.60.085.
1. Offices, administrative, professional, medical, dental and optical laboratories associated with a professional use, real estate, insurance, stocks and bonds and other similar offices characterized by absence of retail sales.
2. Retail sales by a pharmacy within a medical building.
In addition, uses listed in the Conditional Use Permit table in Town Code Section 29.20.185 as conditional uses for the office zone may be allowed if a Conditional Use Permit is obtained.
PARKING REQUIREMENTS:
1. Business office, professional office, and pharmacy retail: One parking space for each 235 square feet.
2. Medical or Dental Clinic: One parking space for each 250 square feet or six spaces per doctor, whichever is more restrictive.

DEVELOPMENT REGULATIONS:
Minimum Lot Area: 8000 square feet
Yards: Front – 25 feet Side – 10 feet Rear – 20 feet Side abutting street – 15 feet
A six-foot high masonry wall is required along any property line abutting a residentially zoned lot.
Maximum Height: Thirty five (35) feet for principal building and fifteen (15) for accessory building.
Maximum Lot Area Coverage: 40%
AFFORDABLE HOUSING OVERLAY ZONE:
The Town’s Housing Element designates this site as an Affordable Housing Overlay Zone site for affordable housing. The proposed property can be developed using the underlying zoning requirements or the requirements of the Affordable Housing Overlay Zone. The Affordable Housing Overlay Zone requirements for this site are currently being developed and are anticipated to be completed by April 2012.
TOWN COUNCIL DIRECTION:
Attached is a Town Council Resolution (approved unanimously on September 19, 2011) indicating the Town’s interest in retaining these properties as office, preferably medical offices, or as affordable housing to be defined under the Affordable Housing Overlay Zone. Market-rate residential development is discouraged for this site.
DESIGN REVIEW AND PROJECT APPROVAL PROCESS:
• Some uses require a Conditional Use Permit (see Conditional Use Permit table in Town Code Section 29.20.185).
• Any new business requires a Certificate of Use and Occupancy from the Community Development Department and a Business License from the Business License Division.
• Proposed redevelopment of the site should go through the Conceptual Development Advisory Committee review process.
• Demolition of the existing improvements and construction of new buildings requires approval of an Architecture and Site application.
• Exterior modifications may require approval of an Architecture and Site application.
• Exterior and interior modifications require building permits.

9-1-1 and non emergency calls can be transferred to a translator. Los Gatos dispatchers are able to handle calls directly from the TTY.
REMEMBER...
When calling 9-1-1, it is very important to stay on the phone, even if 9-1-1 was dialed in error. Even if you hang up, prior to the phone ringing, we get the 9-1-1 call. The dispatcher is required to verify where the call is coming from. If you hang up and the dispatcher is unable re-contact you, a police officer will be sent to the location the 9-1-1 computer provides.
